Terms and conditions

§1 The Parties
These are terms and conditions between Call Norwegian AS as The Supplier and The Customer for the supply of CallNorwegian as The Service.
The Customer may transfer the CallNorwegian-subscription to other persons who accept The Supplier’s conditions for this service. The Supplier may transfer this agreement to a 3rd party following notification published on The Suppliers website.

§2 Agreement
The Service shall only be used in compliance with these terms and conditions. The terms and conditions are considered as accepted by The Customer upon confirmation by The Supplier that The Customer’s order for The Service has been accepted, or upon the first time use of The Service by The Customer.
The Supplier accepts maximum five (5) users per subscription by one legal entity unless otherwise is specifically agreed.

The Supplier is free to deny access or terminate the supply of The Service without explanation.

The Customer will upon invocation of the right to withdraw from access to The Service (Angrerett) be invoiced in accordance with The Suppliers prices valid at the time for any services used as described in these terms and conditions.

§3 The Service
These are terms and conditions for the use of The Service in the location(s) The Supplier offers The Service at any given time.

The Service consists of the possibility for voice communication over IP. The Customer may use The Service for personal use within the limitations set forth in these terms and conditions.

Maintenance and development of The Service shall be conducted in accordance with applicable laws and regulations. The Supplier reserves the right to conduct maintenance without accepting any responsibility for losses or consequences such maintenance may result in.

The Service is not a replacement for your telephone. The Service does not allow you to make emergency calls to emergency services and The Customer accepts that CallNorwegian is not required to offer access to Emergency Services under any applicable local or national rules or law. The Supplier does not take any liability for failed emergency calls.

§4 Use of The Service
The Customer may not sell, lend or rent out The Service to a 3rd party, neither for a fee nor free of charge. The Customer is responsible for any use of The Service.

These terms and conditions apply to the use of additional, related services, unless otherwise is specially agreed.

Disruptions in The Service may from time to time occur. Scheduled, lengthy disruptions shall if possible be notified in advance within The Service. The Supplier has no obligations or responsibilities in relation to any loss or inconvenience arisen as a consequence of a disruption to The Service.
When using data connection from another supplier than Call Norwegian AS or Norwegian Air Shuttle ASA the terms and conditions of the other supplier will come into force.

Any data connection costs arising from the use of The Service are the sole responsibility of The Customer.

The Customer agrees in general to follow common ethical rules applicable to The service and is obliged without hesitation to notify The Supplier of any irregularities to The Service, such as but not limited to hacking, cracking, phishing, fraud, etc discovered by The Customer. The Customer agrees to conduct the use of The Service in public spaces in a non-offensive manner. The Customer agrees to not use The Service in receiving or distributing illegal content, the spreading of viruses, use The Service for spam activities, or sending commercial messages or other non-solicited messages to unknown recipients who have not agreed to receive such messages.

§5 Personal data
The Customer agrees to inform The Supplier of any changes to its personal data relevant to The Service. The Customer hereby gives The Supplier right to obtain information from public and credit information sources relevant to supply of The Service to The Customer.

The Supplier will not disclose any information related to the relationship between The Customer and The Supplier to any 3rd party unless requested to do so by appropriate official authorities.

§6 The Supplier’s obligations
The Service is supplied in accordance with appropriate laws and regulations as well as commonly accepted standards of service.
The Supplier shall provide simple and predictable services, including prices and quality of service.

The Supplier provides customer support from support.

The Supplier is not responsible for any equipment used with The Service potential influence on other electronic equipment or persons situated near the equipment.

The Supplier bears no responsibility for the content being sent or received using The Service.

§7 The Customer’s obligations
The Customer agrees to pay for the use of The Service. Calling other CallNorwegian users does not require payment.

The Customer must have a device that supports The Service and a wireless Internet connection. A list of supported devices can be found here.

The Customer is responsible for the correct treatment of passwords and other codes . Such codes shall be kept and treated in such manner that they remain undisclosed to a 3rd party at all times. It is regarded as breach of the terms and conditions of The Service to note down passwords or other codes related to The Service, or to leave equipment related to The Service in an unprotected state while The Service is active. Any unauthorized access to The Service, suspected or real, The Customer agrees to change the password without delay.

The Customer is responsible for any misuse until notification of such misuse is received by The Supplier. From notification until actual suspension of The Service The Customer is only responsible for the continued misuse if he/she has allowed the misuse to take place by either gross misconduct or intent. Any fixed costs are still payable, and the terms and conditions of The Service still apply regardless if The Service is suspended or not.

Some countries have restricted use of services that utilize a wireless connection for calling (Voice Over Internet Protocol– VOIP), it is The Customer's responsibility to ensure that it is allowed to use The Service from The Customers location.

Use of The Service on board Norwegian's aircrafts must follow any instruction given by Norwegian. Norwegian has the right to limit your use of The Service on board if you are not following such instructions.

§8 Pricing and Payment

The current pricing of The Service is available her.
It is the responsibility of The Customer to ensure the balance is correct after buying more minutes.

Any unused balance will expire following 9 months of continuous inactivity of The Service.

Errors in buying more minutes or any unused balance by suspension of The Service under §7 of these terms and conditions will not be refunded to The Customer unless The Supplier is at fault.

§9 Misconduct/Cancellation
Common remedies for misconduct may be invoked by either party. The Supplier may suspend access to The Service if The Customer is guilty of misconduct. This also applies in the case of suspected breach of conditions or common ethical rules as set forth in these terms and conditions. Any fixed costs are still payable, and the terms and conditions of The Service still apply during such suspension. If the misconduct is remedied by The Customer The Supplier may lift the suspension of The Service to The Customer. The Customer may in such case be charge a fee for reopening The Service.
Both parties may discontinue the relationship immediately in the case of gross misconduct. Financial misconduct is always considered as gross misconduct.
Both parties may demand compensation for financial losses occurred as a result of misconduct. The Supplier limits its compensation or discount responsibilities to maximum NOK 10,000.00 (ten thousand) per incident, or chain of incidents arisen from the same misconduct. The Supplier is not responsible for losses due to faulty equipment owned by The Customer or a 3rd party. The Supplier is not responsible for any indirect losses.

The parties may terminate the relationship mutually with thirty (30) days written notification. The cancellation period runs from the first day in the next calendar month following the cancellation.

§10 Disputes
These terms and conditions are governed by the laws of Norway. Any disputes shall be settled in the Courts of Oslo (Tingrett).
